De familie Kuipers zegt forse overlast te hebben van het stoken van een houtkachel door de overbuurman, onder meer gezondheidsklachten. De gemeente Oldenzaal zegt dat er geen mogelijkheden zijn het stoken aan te pakken.

Het echtpaar Kuipers vindt dat de Nederlandse rechters hun gezondheid niet beschermt. Vandaar dat het met advocaat Dirk Sanderink van Damsté uit Enschede nu naar het Europees Hof voor de Rechten van de Mens stapt. Om dit te financieren is een crowdfundingsactie opgezet. Er is naar schatting 15.000 euro nodig.
